Draft Act on Protection Against Deceptive Technically Generated Recordings

The development of artificial intelligence and new digital technologies brings not only new opportunities but also new risks to privacy and personality rights. One such risk is the creation or dissemination of deceptive visual, audio, or audiovisual recordings that appear to be authentic, even though they have been technically generated or substantially altered.

The development of artificial intelligence and new digital technologies brings not only new opportunities but also new risks to privacy and personality rights. One such risk is the creation or dissemination of deceptive visual, audio, or audiovisual recordings that appear to be authentic, even though they have been technically generated or substantially altered.

In response to these concerns, a group of Members of Parliament has introduced a bill amending certain acts in connection with protection against the unauthorised creation and dissemination of deceptive recordings that have been created or substantially altered through technical means (the "Draft Act"). The Draft Act is currently under consideration by the committees of the National Council of the Slovak Republic following its first reading.

The objective of the Draft Act is to expressly recognise that a technically generated or manipulated recording may constitute an infringement of an individual's personality rights in the same way as an authentic recording of reality.

The proposed effective date of the Draft Act is 1 January 2027.
