Martin Škubla
Attorney and Founding Partner
Partneri Advokáti
Martin Škubla is an attorney-at-law and a founding partner of the law firm Škubla & Partneri. Martin Škubla is a lawyer and founding partner of the law firm Škubla & Partners. He specializes in private equity, disputes and arbitration, economic crime, and healthcare and health insurance.
He graduated from the Faculty of Law of Comenius University in Bratislava, where he obtained a Master of Laws (Mgr.) degree. He began his career as a research and teaching assistant in the field of commercial law at the Police Academy. From 1996 to the present, he has worked in independent law firms.
He became a commercial lawyer in 2000, and following the merger of the Chamber of Commercial Lawyers with the Slovak Bar Association in 2004, he has practised as an attorney-at-law.
Over the course of three decades, Martin has focused on a wide range of legal fields and the practical needs of a broad, predominantly corporate clientele. His primary areas of practice have included commercial (corporate) law, strategic management of litigation, criminal law, and healthcare regulation.
Martin has extensive experience in providing legal advice in banking, energy, health insurance, pharmacy, healthcare services, television broadcasting, the gaming industry, and the protection of privacy against unlawful surveillance. He has participated in the drafting of legislative proposals, managed major court and arbitration proceedings, contributed to the preparation and implementation of large-scale corporate combinations, and worked on significant criminal cases. In the field of taxation, he has advised not only in VAT audits but also successfully assisted in court proceedings before the European Court of Justice, which resulted ipso facto in the annulment of an unlawful Slovak tax (on emission allowances).
He was involved in shareholder disputes concerning Slovakia’s largest commercial television broadcaster, in managing disputes between the former largest Slovak steel producer and its creditors, and in the preparation and implementation of its transformation from a publicly traded joint-stock company into an investment cooperative. He also took part in the transformation of Slovak health insurance companies and the third pension pillar into joint-stock companies, in constitutional, arbitration, and court disputes concerning the so-called ban on profits of health insurance companies, in the settlement of a banking dispute exceeding EUR 100 million, in the acquisition of two banks, in the enforcement of a claim against a state-owned energy company exceeding one billion Slovak crowns, as well as in landmark decisions of civil, constitutional, and European courts concerning the protection of privacy against secret service surveillance. He has also represented a state institution, private companies, and individuals in disputes with attorneys over excessive fee claims.
Despite the responsibilities arising from managing a law firm that has gradually expanded, Martin has remained above all a practising lawyer. He says that he does not seek out legal problems—they seek him out. A lawyer should be someone who guides clients through a world of rules and helps them find solutions appropriate to their situation, while not hesitating to fight meaningful disputes in their interest, nor to avoid those that make no sense. Anyone who fulfils this mission of the legal profession builds their professional profile—regardless of the size or prominence of the cases—through work that is worthwhile for clients, society, and themselves. In other words, they deliver results to clients by protecting their rights, defending them against injustice, and sometimes even against themselves, when their understanding of their legal situation is mistaken.
