The Constitutional Court has set limits on the regulation of nongovernmental organizations

In its ruling PL. ÚS 11/2025-116, the Constitutional Court of the Slovak Republic assessed the constitutionality of the amendment to the Act on Non-Profit Organizations, emphasizing the limits on interference with the freedom of association, the protection of donors’ privacy, and the impermissibility of blanket disclosure of data.

Ruling PL. ÚS 11/2025 represents a significant affirmation that regulation of the non-governmental sector is also subject to constitutional limits. The Constitutional Court emphasized that non-governmental organizations remain entities governed by private law and that the state cannot impose public law obligations on them without demonstrating their necessity and proportionality.

The Constitutional Court also confirmed that a democratic society must protect the autonomy of civil society and respect the right of individuals to support organizations according to their own convictions without an unreasonable risk of public stigmatization.

Transparency in public life and the fight against crime are legitimate goals, but their enforcement must respect the principle of proportionality and must not lead to blanket and undifferentiated infringements on fundamental rights. Otherwise, the very foundations of a democratic and constitutional state are undermined.
